GENERAL TERMS AND CONDITIONS

ARTICLE 1 - PRICE

1.1  The pricing of our products is given in euros inclusive of all taxes and exclusive of processing costs of delivery

1.2  Processing costs are payable when you ask us to burn a CD Rom or load an MP3 player with the guides you've selected. You will be advised of these costs during the ordering process so that you can select this option with full knowledge of the facts

1.3  Delivery costs will be given during the ordering process, after you have stated your delivery address.

1.4  When a customer places an order from outside metropolitan France, they are considered an importer of the product or products in question. For all products dispatched outside of the European Union and DOM-TOM regions, the price stated in the invoice will automatically be before tax. Customs duties, local taxes, import taxes or government taxes may well be payable. These duties and charges are not the responsibility of PocketVox.com. They will be at your expense and entirely your responsibility, both in terms of declaration and payment to the relevant authorities or bodies in your country. We recommend you make enquiries with your local authorities on this matter.

1.5  Our prices are subject to variation at any time but the products and services will be invoiced at the current rate shown when the order is placed.

1.6  The products remain the property of PocketVox until the full purchase price has been paid.

ARTICLE 2 - INTELLECTUAL PROPERTY

All the audio guides, comments and images on the site remain the property of PocketVox and are protected under copyright and the intellectual property code of practice. As such, and in accordance with the law regarding intellectual property, any reproduction, copy or distribution is strictly forbidden and subject to substantial penalty.

ARTICLE 4 - VALIDATION

You must declare you have read and accepted these general terms and conditions of sale before confirming your order. The subsequent validation of your order is therefore considered as your acceptance of these general terms and conditions of sale.

Unless there is evidence to the contrary, the data recorded by PocketVox.com constitutes proof of all transactions undertaken between PocketVox.com and its customers.

ARTICLE 5 - AVAILABILITY

The products we "physically" deliver, such as MP3 players, are usually in stock. If this is not the case, they're generally available through our suppliers.

If however, once your order has been placed we find they are not available, we will advise you of this by e-mail or post, as soon as we ourselves have been informed by our suppliers. Your order will automatically be cancelled and if your account has been debited, you will be reimbursed immediately.

ARTICLE 6 - AVAILABILITY OF AUDIO GUIDES

The audio guides you have ordered are in audio file format. Once payment has been made, these files are placed in a deposit box in your name from where you can download them.

This deposit box is accessible under your account. Files will remain available there to download for a period of 4 days.

ARTICLE 7- DELIVERY OF PHYSICAL MERCHANDISE

Merchandise will be delivered to the address you indicate during the ordering process.

An estimated delivery date will be given during the ordering process once you have stated your address. This will take into account normal average delivery times.

Delivery time includes transportation, order processing as well as burning a CD Rom or loading an MP3 player, if you have chosen one of these options.

When you order several items at the same time with different delivery dates, we will quote the latest date for the estimated delivery. We reserve the right to dispatch items separately and in this case, the second and subsequent consignments will be at the expense of PocketVox.

PocketVox cannot be held responsible for delays in delivery. In the event of such delays, you will be advised by e-mail.

If this delay is likely to be more than 30 days, you are free to cancel the order and be reimbursed.

We suggest you track the progress of your order under your account.

ARTICLE 8 - PAYMENT

The payment of your purchase is made by bankers card. Your card will only be debited at the moment of dispatch in the case of a physical item or when the audio files are made available to you in your deposit box. This deposit box is located under your account.

ARTICLE 9 - SECURITY

PocketVox is a secured site and we use the SSL encryption process.

ARTICLE 10 - CORRECT DOWNLOAD OF AUDIO GUIDES

If ? in the permitted time under article 6 above ? you are unable to download your purchased guides from your deposit box, please notify us by e-mail at :

serviceclient@pocketvox.com Be sure to identify yourself and provide details of the problem encountered.

ARTICLE 11 - CONFORMITY OF PHYSICAL MERCHANDISE

By physical merchandise, PocketVox means a product that is to be dispatched to the delivery address indicated in the order. Principally this will be MP3 players and CD ROMs.

We guarantee reimbursement or an exchange for any apparently faulty, spoilt or damaged goods, or goods that do not correspond to your order. In this instance, we would ask you to provide us with detailed written information and return the items to the following address :

PocketVox- 60, rue La Boétie- 75008 Paris. France.

PocketVox will then exchange or reimburse the product(s), according to your preference. Any claims must be submitted within 15 working days of delivery. Claims received after this deadline will not be accepted.

The cost of retuning the goods will be reimbursed according to the actual costs incurred and you will be reimbursed return costs.

Whatever the case, you are covered by the standard terms of guarantee and in particular those relating to latent defects.

The refund will be made in 15 days or earlier, further to our receipt of the returned products.

Pocketvox will determine the method of refund. This will either be in the form of a credit to your bank account or by cheque sent to the invoice address and made out to the customer who placed the order.

ARTICLE 12 - RESPONSIBILITY

The products on offer comply with present French legislation. PocketVox cannot be held responsible if the legislation of the country where the merchandise is delivered is not respected. It is your responsibility to check with local authorities about the feasibility of importing or using the products and services that you intent to purchase.

ARTICLE 13 - GOVERNING LAW - LITIGATION

The present contact is governed by French law.

Any disputes that may arise shall be subject only to the jurisdiction of the courts of France
